Terms of Service & User Agreement

Welcome to Nityaved. These Terms of Service (“Terms”) constitute a legally binding electronic agreement between you (“User,” “you,” or “your”) and Nityaved (“Nityaved,” “we,” “our,” or “us”), governing your access to and use of https://nityaved.com, including our job search engine, company portals, developer API, and MCP services.


1. Description of Service & Non-Recruiter Status

Nityaved is an independent search engine and career discovery platform. We index publicly available employment opportunities directly from enterprise Applicant Tracking Systems (such as Workday, Greenhouse, Lever, Ashby, and SmartRecruiters) and redirect candidates directly to the employer’s official career website.

Critical Disclosure: Nityaved is not an employer, recruiter, staffing agency, employment consultant, or placement firm. Nityaved does not participate in hiring decisions, screening interviews, wage negotiations, or candidate evaluations. No placement or recruitment fee is ever charged to candidates.

2. Eligibility & Account Security

By accessing Nityaved or creating an account, you represent and warrant that:

  • You are at least 18 years of age and legally capable of entering into binding contracts under the Indian Contract Act, 1872.
  • All registration information submitted via Supabase Auth is accurate, current, and complete.
  • You are solely responsible for maintaining the confidentiality of your account credentials and for all activities conducted under your account.

3. Acceptable Use & Prohibited Conduct (IT Rules 2021)

In accordance with Rule 3(1)(b) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, you agree that you shall not host, display, upload, modify, publish, transmit, or share any information that:

  • Belongs to another person and to which you do not have any right.
  • Is defamatory, obscene, pornographic, pedophilic, invasive of another’s privacy, insulting or harassing, hateful, or racially or ethnically objectionable.
  • Infringes any patent, trademark, copyright, or other proprietary rights.
  • Deceives or misleads the addressee about the origin of the message or knowingly communicates any misinformation.
  • Contains software viruses or any other computer code designed to interrupt, destroy, or limit the functionality of any computer resource.

Additionally, you agree not to scrape, harvest, systematically extract, or crawlNityaved’s aggregated database, bypass our rate limits, reverse engineer our application, or exploit our MCP/API interfaces outside their documented intended use.

4. Third-Party Information & Section 79 Intermediary Safe Harbor

Statutory Intermediary Statement (IT Act, 2000):

Certain job listings, employer descriptions, location data, requirements, and application links made available through the Service originate from third-party employers and ATS sources (“Third-Party Information”). To the extent Nityaved receives, stores, indexes, caches, transmits, or provides access to particular Third-Party Information, Nityaved acts purely as an intermediary under Section 2(1)(w) of the Information Technology Act, 2000.

Nityaved relies on the safe harbor protections provided under Section 79 of the Information Technology Act, 2000. Nityaved does not initiate the transmission, does not select the receiver of the transmission, and does not alter the information contained in the requisition. Nityaved does not endorse, guarantee, or assume liability for the accuracy, legality, or completeness of third-party job listings.

5. Intellectual Property & Nominative Fair Use

Nityaved IP: The Nityaved platform, user interfaces, branding, domain names, database taxonomy, original editorial career articles, and software architecture are the exclusive intellectual property of Nityaved.

Third-Party Trademarks: All third-party company names, employer marks, and ATS platform names (including but not limited to Workday, Greenhouse, Lever, Ashby, Oracle Cloud HCM, SmartRecruiters, and company hiring brands) remain the exclusive property of their respective trademark holders. Such names and marks are referenced on Nityaved strictly under the doctrine of nominative fair use (Section 30 of the Trade Marks Act, 1999) solely to accurately identify the source of the job opening and technical application destination. No sponsorship, affiliation, partnership, or endorsement is implied.

6. Developer API & Model Context Protocol (MCP) Terms

If you access our developer API or Model Context Protocol (MCP) server:

  • You receive a non-exclusive, revocable, non-transferable licence to query job metadata strictly for internal or agentic search use.
  • You must adhere to the atomic rate limits enforced by our Upstash Redis layer. Circumventing rate limits through multiple keys or distributed IPs will result in immediate termination.
  • You may not resell, sublicense, or redistribute our raw indexed job database as a competing commercial aggregation product.

7. Takedown, Stale Listings & Grievance Mechanism

If you are an employer, ATS provider, or authorized representative and wish to request the update, correction, or removal of an indexed job listing or trademark reference, please submit your request to our Grievance Redressal Officer at grievance@nityaved.com. In accordance with Rule 3(2) of the IT Rules 2021, we acknowledge all notices within 48 hours and process verified removals within statutory timelines.

8. Disclaimer of Warranties & Limitation of Liability

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. NITYAVED EXPRESSLY DISCLAIMS ANY WARRANTY THAT (I) JOB LISTINGS WILL BE UNINTERRUPTED OR ERROR-FREE, (II) APPLICATION DESTINATIONS WILL REMAIN ACTIVE, OR (III) SUBMITTING AN APPLICATION WILL RESULT IN AN INTERVIEW OR JOB OFFER.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL NITYAVED, ITS FOUNDERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE PLATFORM.

9. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of India. Subject to the grievance redressal provisions of the DPDP Act 2023, any legal dispute, claim, or controversy arising out of these Terms shall be subject to the exclusive jurisdiction of the competent courts in Pune, Maharashtra, India.
